Terms and Conditions USER AGREEMENT & TERMS OF SERVICE

1. DEFINITIONS

For the purposes of this Agreement:

“Jaan’s Cafe”, “we”, “our”, or “us” refers to Jaan’s Cafe and its authorized representatives.

“Customer”, “you”, or “User” refers to any individual placing an order through our Services.

“Services” means all ordering, payment, customer support, delivery, promotional, and loyalty services offered by Jaan’s Cafe.

“Order” means any request submitted by a Customer for the purchase of food, beverages, or related products.

“Delivery Partner” means any third-party courier, rider, or logistics provider engaged in the delivery of Orders.

“Platform” means our website, mobile applications, social media channels, and messaging services through which Orders may be placed.

2. GENERAL PROVISIONS

This Agreement constitutes a legally binding arrangement between Jaan’s Cafe and the Customer.

The use of our Services constitutes acceptance of these Terms and any related policies published by Jaan’s Cafe from time to time.

Jaan’s Cafe reserves the right to amend, modify, or replace these Terms at its sole discretion. Continued use of our Services after such amendments shall constitute acceptance of the revised Terms.

 

If you do not agree with any part of this Agreement, you must immediately discontinue use of our Services.

3. ORDERING SERVICES

Orders may be placed through approved ordering channels made available by Jaan’s Cafe.

An Order shall only be considered accepted once:

  • Payment has been successfully authorized (where applicable); and
  • An order confirmation has been issued.

Jaan’s Cafe reserves the right to reject, suspend, or cancel any Order due to operational constraints, product unavailability, suspected fraudulent activity, technical errors, or circumstances beyond our reasonable control.

4. PAYMENTS

Customers may pay for Orders using payment methods approved by Jaan’s Cafe, including:

  • Cash on Delivery;
  • Debit Cards;
  • Credit Cards;
  • Mobile Wallets;
  • Digital Payment Gateways.

All online payments are processed through secure third-party payment providers.

Jaan’s Cafe does not store complete payment card information and shall not be responsible for losses arising from unauthorized use of payment instruments outside our control.

5. CUSTOMER OBLIGATIONS

The Customer agrees:

  • To provide accurate contact and delivery information;
  • Not to misuse or interfere with the operation of our Services;
  • Not to submit fraudulent Orders;
  • To treat employees, representatives, and delivery personnel respectfully;
  • To comply with applicable laws and regulations while using our Services.

Jaan’s Cafe reserves the right to suspend or refuse service to any Customer who violates these obligations.

6. CANCELLATION OF ORDERS

Due to the perishable nature of food products, Orders may only be cancelled before food preparation has commenced.

Once preparation begins, Jaan’s Cafe may decline cancellation requests.

Approved refunds shall be processed according to the payment method used for the original transaction.

7. FOOD SAFETY & ALLERGEN NOTICE

While Jaan’s Cafe follows reasonable food safety standards, Customers with allergies or dietary restrictions must notify us before placing an Order.

Jaan’s Cafe cannot guarantee that any product is completely free from allergens.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Jaan’s Cafe shall not be liable for:

  • Delays caused by traffic, weather, or third-party delivery providers;
  • Service interruptions beyond our control;
  • Indirect, incidental, or consequential damages;
  • Customer losses resulting from inaccurate delivery information supplied by the Customer.

Any liability of Jaan’s Cafe shall be limited to the value of the affected Order.

9. PRIVACY & DATA PROTECTION

Jaan’s Cafe may collect and process personal information necessary for:

  • Order fulfilment;
  • Customer support;
  • Delivery services;
  • Service improvement and analytics.

Customer information shall be handled responsibly and in accordance with applicable laws of Pakistan.

10. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement shall be governed by the laws of the Islamic Republic of Pakistan.

Any dispute arising out of or relating to this Agreement shall first be resolved through good-faith negotiations. Where resolution cannot be achieved, the matter shall be subject to the exclusive jurisdiction of the courts of Islamabad, Pakistan.
